Terms of Service

These Terms, along with our Privacy Policy and any additional guidelines or policies we post, constitute the entire agreement between you and SignSafe regarding your use of the platform.

If you are using SignSafe on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you and that entity.

SignSafe reserves the right to refuse service to anyone at any time for any lawful reason.

Without limiting the foregoing disclaimer, you specifically acknowledge:

• AI risk scores are probabilistic indicators, not legal determinations.
• A "low risk" rating does not mean a clause is legally enforceable, fair, or appropriate for your situation.
• SignSafe does not review documents for compliance with industry-specific regulations (e.g., SEBI, RBI, FDA, labour laws) unless explicitly stated.
• SignSafe does not verify the authenticity, completeness, or genuineness of any uploaded document.
• Analysis is based on the text extracted from your document. Handwritten notes, stamps, annexures, or referenced external documents are not independently analysed unless included in the upload.
• Pursuant to the proposed Regulations for Use of Artificial Intelligence in Courts, 2026 (Draft) of the Supreme Court of India, if you intend to submit any document or pleading to a court that was assisted by AI, you may be required to disclose such assistance. Consult your lawyer.

You must be at least 18 years of age and legally capable of entering into binding contracts under applicable Indian law to use SignSafe.

By using the service, you represent and warrant that:

• You are 18 years of age or older.
• Your use of SignSafe does not violate any applicable law or regulation.
• You are not a person barred from receiving services under the laws of India or any other applicable jurisdiction.
• If you are a lawyer or legal professional, you remain solely responsible for compliance with the Bar Council of India Rules, including duties of confidentiality to your clients.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account, whether authorised or not.
• Promptly notifying us at support@signsafe.in of any suspected unauthorised access.

You may not share your account with others. Corporate plans that allow team access must be managed through the designated team management features.

We reserve the right to terminate or suspend your account immediately if we reasonably believe you have violated these Terms.

You agree NOT to use SignSafe to:

Your Content: You retain full ownership of all documents you upload ("Your Content"). By uploading, you grant SignSafe a limited, non-exclusive, worldwide, royalty-free licence to process Your Content solely as necessary to perform the analysis. The uploaded source files are deleted immediately after the analysis is completed.

Only the generated analysis report results are retained under your account, and the licence to display those results terminates when you delete the report or close your account.

Our Platform & AI Output: SignSafe, its AI models, interface, algorithms, and the template analysis framework are owned by SignSafe Technologies Pvt. Ltd. and protected by applicable intellectual property laws. The analysis reports generated for your specific document are provided to you for your personal or internal business use.

You may not reproduce, sell, or redistribute our analysis reports or platform content without prior written consent.

No Training Use: We do not claim ownership of your documents for AI training purposes. See our Privacy Policy — Section 3 for details on how document data is handled.

Specifically, our AI may:

• Misinterpret complex, highly technical, or unusual legal language.
• Fail to flag risks that are apparent to a domain-expert lawyer.
• Apply general legal principles that are not applicable to your specific jurisdiction or situation.
• Generate plausible-sounding but legally incorrect explanations ("hallucination").
• Miss context that only appears in referenced schedules, annexures, or side letters not included in the upload.

SignSafe makes no representation or warranty that any analysis is legally accurate, complete, or current as of the date of analysis.

Free Tier: SignSafe currently offers a free tier with limited analyses per month. We reserve the right to modify the free tier limits at any time with 30 days' notice.

Paid Plans: If you subscribe to a paid plan:

• Fees are billed in advance on a monthly or annual basis (as selected).
• All fees are exclusive of GST, which will be charged at the applicable rate.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Refunds are available within 7 days of purchase if the service was materially defective. No refunds are issued for change-of-mind or partial-use.
• We reserve the right to change pricing with 30 days' notice. Your current subscription price is locked until the next renewal date.

Our total aggregate liability to you for all claims arising out of or related to these Terms or your use of the platform shall not exceed the greater of:

• (a) The total fees paid by you to SignSafe in the 12 months preceding the claim; or
• (b) ₹5,000 (Indian Rupees Five Thousand).

Nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by negligence — where such limitation is prohibited by law.

You specifically acknowledge that SignSafe is not liable for any loss, damage, or liability arising from:

• Errors or inaccuracies in AI-generated analyses.
• Your decision to sign, reject, or modify a contract based on SignSafe's analysis.
• Confidentiality breaches arising from documents you choose to upload.
• Loss of business or contractual opportunity arising from reliance on our analysis.

You agree to indemnify, defend, and hold harmless SignSafe and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your violation of any third party's rights, including intellectual property or privacy rights.
• Any content or documents you upload to the platform.
• Your use of SignSafe in a manner not authorised by these Terms.
• Any dispute between you and a counterparty to a contract that you reviewed using SignSafe.

By you: You may delete your account at any time from account settings. Deletion takes effect within 24 hours. Paid subscriptions are not refunded upon self-termination unless within the 7-day refund window.

By us: We may suspend or terminate your account immediately and without notice if:

• You breach any provision of these Terms.
• We are required to do so by applicable law or a court order.
• Your account shows signs of fraudulent, illegal, or abusive activity.

Upon termination, your right to use the platform ceases immediately. Sections 2 (Disclaimer), 6 (IP), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and 13 (Disputes) survive termination.

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Subject to Section 13 (Dispute Resolution), the courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising from these Terms.

Informal Resolution First: Before filing any formal claim, both parties agree to attempt good-faith resolution by contacting us at legal@signsafe.in. We will respond within 15 business days.

Arbitration: If informal resolution fails within 60 days, disputes (other than small claims) shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The seat and venue of arbitration shall be Bengaluru, Karnataka. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, and this does not waive the right to arbitrate.

Class Action Waiver: You agree to bring disputes only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Send an email notification to registered users at least 14 days before the changes take effect.
• Display a prominent notice in the platform for 30 days.

Your continued use of SignSafe after the effective date of any changes constitutes acceptance of those changes. If you do not agree, you must stop using the platform and may close your account.
